Rental Agreement

This Rental Agreement ("Agreement") is between Olivia Rafferty, trading as The Wedding Tape, of 1 Wharf Lane ("we", "us", "our"), and the customer ("you", "your").

‍ ‍

By placing an order, or by receiving and using the Equipment, you agree to be bound by this Agreement.

‍ ‍

1. What You're Hiring

‍ ‍

1.1 We hire out camcorder equipment ("Equipment") for use at your wedding, as selected and paid for at checkout — currently The Retro Reel or The Modern Reel, each including a camcorder(s), memory card, battery/charger, and any accessories listed on the product page at the time of order.

‍ ‍

1.2 Alongside the equipment hire, we also provide an editing service: we return all raw footage to you and produce a professionally edited highlights film (typically 4–7 minutes). These editing services are governed by this Agreement together with our [Terms & Conditions link].

‍ ‍

2. Hire Period

‍ ‍

2.1 The hire period begins when the Equipment is delivered (or first delivery is attempted) by our courier, and ends 72 hours after your wedding date.

‍ ‍

2.2 We aim to deliver the Equipment 4–5 days before your wedding date, fully charged and ready to use. Delivery timeframes are estimates; we are not responsible for courier delays outside our control.

‍ ‍

2.3 You must repackage and return the Equipment within 72 hours of your wedding, using the prepaid returns label provided in the original box. Please keep your proof of postage until we confirm receipt.

‍ ‍

2.4 If the Equipment is not returned within the agreed hire period, we may charge you a late return fee for each additional day, and/or the full replacement cost of the Equipment if it is not returned within a reasonable further period.

‍ ‍

3. Payment

‍ ‍

3.1 Full payment is taken at the time of booking, before the Equipment is dispatched.

‍ ‍

3.2 Once the Equipment has been dispatched, the hire fee is non-refundable, except where required by law or as set out in our Video Guarantee below.

‍ ‍

4. Your Responsibilities

‍ ‍

While the Equipment is in your possession, you agree to:

‍ ‍

  • use it carefully, sensibly, and in line with the instructions and shot list provided;

  • only allow it to be used by someone aged 18 or over;

  • keep it safe, dry, and reasonably secure at all times;

  • not attempt to open, repair, or modify the Equipment yourself;

  • return everything (camcorder(s), memory card, charger, cables, and packaging) in the same condition it was sent, fair wear and tear excepted;

  • let us know as soon as possible if anything is lost, damaged, or not working.

5. Loss, Damage and Fees

‍ ‍

5.1 The Equipment remains our property at all times. You are responsible for it from the moment of delivery until we receive it back.

‍ ‍

5.2 If the Equipment is returned damaged (beyond fair wear and tear), lost, or not returned at all, we may charge you:

‍ ‍

  • the reasonable cost of repair, or

  • if the item cannot be repaired or is not returned, its full replacement value.

‍ ‍

5.3 We will always tell you the reason for any charge and give you the chance to respond before charging your payment method on file.

‍ ‍

5.4 We recommend checking whether your home contents insurance covers hired electronic equipment while it's in your care.

‍ ‍

6. Our "Video Guarantee"

‍ ‍

6.1 We know how much this footage matters, so if any of the following happen, you're entitled to a full refund of your hire fee:

‍ ‍

  • the Equipment itself was faulty and this caused a failure to record (not user error);

  • despite following our setup instructions correctly and using working Equipment, no usable footage was captured through no fault of your own; or

  • your parcel is lost in the post before reaching you, or on its way back to us, through no fault of your own, and as a result no footage can be recovered.

6.2 The guarantee does not cover:

‍ ‍

  • user error (for example, the camcorder not being switched on, not being pointed at anything, or running out of storage/battery because instructions weren't followed);

  • damage caused while the Equipment was in your possession;

  • failure to return the Equipment to us;

  • changes of mind, cancellations, or postponements (see Section 7); or

  • footage that was captured but that you're simply unhappy with creatively — see Section 8.

7. Cancellations & Postponements

‍ ‍

7.1 If you need to cancel, please tell us as soon as possible by emailing theweddingtapeco@gmail.com.

‍ ‍

7.2 Under the Consumer Contracts Regulations 2013, if you booked online you normally have a 14-day cooling-off period from the date of booking. However, because we usually need to schedule and dispatch Equipment tied to your specific wedding date, this right may be lost once dispatch has begun or once you've asked us to start preparing your order sooner — we'll always tell you clearly at checkout if this applies.

7.3 If you postpone your wedding date and tell us with reasonable notice before Equipment has been dispatched, we'll do our best to move your booking to the new date, subject to availability.

‍ ‍

7.4 Once the Equipment has been dispatched, the hire fee is non-refundable other than under the Video Guarantee (Section 6).

‍ ‍

8. Editing & Creative Style

‍ ‍

8.1 We edit your highlights film in a style consistent with our current portfolio. While we're happy to take on board any preferences you share with us in advance, editing is a creative process and the final artistic judgment is ours.

‍ ‍

8.2 Dissatisfaction with editing style or creative choices is not grounds for a refund under the Video Guarantee, provided footage was successfully captured and delivered.

‍ ‍

8.3 We aim to deliver your raw footage within a few weeks of your wedding, and your edited highlights film shortly after. These are estimates, not guaranteed deadlines, though we'll keep you updated if anything changes.

‍ ‍

9. Ownership & Use of Footage

‍ ‍

9.1 All raw footage captured on the Equipment belongs to you.

‍ ‍

9.2 We may retain a copy of the edited highlights film and use short excerpts or stills for our own marketing (for example, on our website or social media), unless you ask us in writing not to at the time of booking.

‍ ‍

10. Our Liability

‍ ‍

10.1 Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.

‍ ‍

10.2 Subject to Section 10.1, our total liability to you under this Agreement is limited to the amount you paid for your order.

‍ ‍

10.3 We are not liable for footage lost or damaged due to your own actions (including failure to follow setup instructions), or for events genuinely outside our control (force majeure), including postal/courier delays, strikes, or extreme weather.

‍ ‍

10.4 Your statutory rights as a consumer under the Consumer Rights Act 2015 are not affected by this Agreement.

‍ ‍

11. Changes to This Agreement

‍ ‍

We may update this Agreement from time to time, for example to reflect changes in our services or the law. The version that applied at the time you placed your order will govern that order.

‍ ‍

12. Governing Law

‍ ‍

This Agreement is governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
